1. Acceptance of Terms

By accessing or using Hostlee (“the Platform”, “we”, “us”, or “our”), you agree to be bound by these Terms & Conditions and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our service. These terms apply to all visitors, users, venues, and event hosts who access or use the Platform.

2. Description of Service

Hostlee is an online marketplace that connects event hosts (“Hosts”) with venue owners (“Venues”) for private dining, corporate events, celebrations, and other private events. Hostlee facilitates discovery, communication, and the booking process between parties but is not a party to any agreement made between Hosts and Venues. Hostlee does not own, operate, or control any venue listed on the Platform.

3. User Accounts & Eligibility

• You must be at least 18 years old to create an account.
• You agree to provide accurate, current, and complete information during registration and to keep it up to date.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You may not share your account or use another person’s account without permission.
• We reserve the right to suspend or terminate accounts that violate these terms or that we believe pose a risk to the Platform or other users.

4. Venue Listings

Venues are solely responsible for the accuracy, completeness, and legality of their listings, including pricing, availability, photos, descriptions, menus, and policies. Venues must:

• Hold all necessary licences and permits required to operate their venue and serve food and/or alcohol.
• Honor all confirmed bookings and communicate promptly and professionally with Hosts.
• Keep their availability calendar up to date to avoid double-bookings.
• Ensure their listing does not misrepresent the venue, its amenities, or its capacity.

All venue listings are subject to review and approval by Hostlee before being made publicly visible. We reserve the right to remove or suspend listings at our discretion.

5. Bookings & Deposits

Bookings are requests made by Hosts to reserve a Venue’s space for a specific date and time. A booking is only confirmed when both parties have agreed to the terms and, where applicable, a deposit has been paid.

• Deposit amounts and payment terms are set by individual Venues and communicated during the booking process.
• Deposits are processed securely through Stripe and paid directly to the Venue’s connected Stripe account.
• Hostlee does not hold deposits on behalf of Venues or Hosts.
• Hosts are responsible for providing accurate guest counts, event details, and any special requirements at the time of booking.

6. Payments & Fees

Payment processing on Hostlee is powered by Stripe Connect. By using the Platform to send or receive payments, you agree to Stripe’s Terms of Service.

• Stripe charges a standard payment processing fee (typically 2.9% + 30¢ per transaction) deducted from each payout to the Venue.
• Venues are responsible for all taxes applicable to payments they receive through the Platform.
• Hostlee may charge a platform subscription fee to Venues for access to listing and management features. Current pricing is available on our website.
• All fees are non-refundable unless stated otherwise.

7. Cancellations & Refunds

Cancellation and refund policies are set by individual Venues and will be communicated to Hosts prior to confirming a booking. Hostlee is not responsible for enforcing or mediating cancellation or refund disputes between Hosts and Venues. We encourage both parties to communicate clearly and resolve disputes in good faith.

8. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable laws.
• Post false, misleading, or fraudulent content, listings, or reviews.
• Circumvent the Platform to conduct bookings or payments outside of Hostlee in order to avoid fees.
• Harass, threaten, or harm other users.
• Attempt to gain unauthorized access to other accounts or the Platform’s infrastructure.
• Scrape, copy, or redistribute any content from the Platform without our written consent.

9. Intellectual Property

All content, branding, logos, and software on the Platform are the property of Hostlee or its licensors and are protected by applicable intellectual property laws. You may not use, reproduce, or distribute any content from the Platform without our prior written permission.

By submitting photos, descriptions, or other content to the Platform, you grant Hostlee a non-exclusive, royalty-free licence to use, display, and promote that content in connection with operating and marketing the Platform.

10. Disclaimers & Limitation of Liability

The Platform is provided “as is” and “as available” without warranties of any kind, either express or implied. Hostlee does not guarantee the quality, safety, legality, or suitability of any venue or event listed on the Platform.

To the fullest extent permitted by law, Hostlee shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform, including but not limited to loss of revenue, loss of data, or damages arising from interactions between Hosts and Venues.

11. Indemnification

You agree to indemnify and hold harmless Hostlee, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any rights of another party.

12. Privacy

Your privacy is important to us. We collect and process personal information in accordance with our Privacy Policy. By using the Platform, you consent to the collection and use of your information as described therein. We do not sell your personal information to third parties.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in New Jersey.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify registered users of material changes via email or a notice on the Platform. Your continued use of the Platform after any changes constitutes your acceptance of the updated Terms. We encourage you to review this page periodically.
